i-Menzies Terms and Conditions of Use

Welcome to iMenzies. These Terms of Use apply whether you have an existing business relationship with InPost Distribution Limited (“Company”) or are just visiting www.i-menzies.com (“Site”). InPost Distribution Limited is a company registered in the United Kingdom, registration number 01430241, with a registered office address of Moray House, 23-35 Great Titchfield Street, London, W1W 7PA, United Kingdom.

1. Use of this Site 

By accessing, browsing and using the Site, you acknowledge that you have read, understood and agree to be bound by these Terms. (the “Terms”). These Terms are a binding legal agreement between us. Please read these Terms carefully before using the Site. If you do not agree to these Terms, do not use the Site.  

2. Authorised Use 

The Site is provided for the purpose of accessing information related to your account and services provided by InPost Distribution Limited. You are granted a limited, non-exclusive, non-transferable, revocable licence to use the Site strictly in accordance with these Terms and any additional policies or agreements provided by InPost Distribution, including but not limited to our Privacy Notice.  

3. User Account and Security 

You agree to provide accurate and current information when creating an account. You are responsible for maintaining the confidentiality of your account credentials and you agree to notify us immediately of any unauthorised access to your account.  

4. Prohibited Uses 

You agree to use the Site only for lawful purposes and in accordance with these Terms. You expressly agree that you will not: 

• Use the i-Menzies platform for any illegal or fraudulent purposes. 

• Upload, store or distribute content that (1) violates intellectual property laws; (2) is defamatory, obscene, illicit or harmful; or (3) promotes illegal activities or violates any applicable laws. 

• Copy, reproduce, modify, display, republish, distribute or transmit any part of the Site or content produced therein without prior written authorisation from us.  

• Attempt to gain unauthorised access to any portion of the Site, it’s systems or networks.  

• Use the Site in any manner that could interfere with, disrupt or negatively affect the operation or security of the Site or the networks and servers of InPost Distribution Limited.  

• Share your secure Site login credentials including username and/or password with any other natural or legal person. Please keep your login details secure at all times. If you believe your login details have been compromised, please inform us immediately.  

• Use any third-party software, scripts or automated tools, including but not limited to “screen scraping tools”, data mining, bots or similar unauthorised technologies, to access, extract or download data from the Site without the express written consent of InPost Distribution Limited. The use of screen scraping tools and other automated methods to access, extract or manipulate data from the Site is strictly prohibited. Any use of these tools by customers or third parties on their behalf is considered a violation of these Terms. InPost Distribution Limited reserves the right to take immediate action, including but not limited to suspension or termination of access to the Site, if it determines that screen scraping, or any other unauthorised data extraction methods have been used.  

5. Content Reporting and Action 

• If you encounter any illegal content on our platform, you must report it using the contact details provided in our Notice and Action policy, which can be found here. 

• We will review reports of illegal content and take appropriate action in accordance with the EU Digital Services Act (“DSA”) and applicable laws. 

• We publish an annual transparency report on Notice and Action taken for the last year. Please see our most recent report here. 

6. Intellectual Property 

All content, materials and features available on the Site, including but not limited to the designs, text, images, graphics, logos, software and content of the Site, are owned by or licensed to InPost Distribution Limited. These content and materials are the intellectual property of the Company or its licensors and are protected by applicable intellectual property laws. You are prohibited from copying, reproducing, modifying, distributing, republishing, displaying, posting, or transmitting any part of this Site without the written permission of the Company. You may view, download or print pages relating to you for your own personal use.  

7. Liability 

We take all measures to ensure the accuracy of all content on the Site. However, we do not accept any liability for the use made by you of the content. We do not provide any warranties in respect of the Site, its content or the accuracy of the information on the Site. The Company, its affiliates or licensors or any third parties mentioned on the Site disclaim to the fullest extent permitted by law all implied warranties applicable to the Site. You should not rely on such information to make (or refrain from making) any decision or take (or refrain from taking) any action. 

To the fullest extent permitted by law, in no event shall InPost Distribution Limited be liable for any incidental, indirect, exemplary, punitive and consequential damages, costs, losses or claims resulting from business interruption attributed to the use of or inability to use this Site. InPost Distribution Limited shall not be liable, either in contract, delict or otherwise, for any consequential or economic loss including, without limitation, any loss of profits, loss of revenue, loss of opportunity or any loss, corruption or destruction of data arising as a result of your use of the Site. InPost Distribution Limited cannot guarantee that the Site will be uninterrupted or entirely error free at any time. Because of the nature of the Internet, the Site is provided on an "as available" basis. InPost Distribution Limited will not be responsible to you if we are unable to provide the Site for any reason beyond our control. 

8. Content and advertisements 

This Site may provide links to and content from other Internet sites and resources. Because InPost Distribution Limited has no control over these sites and resources, you acknowledge and agree that the Company is not responsible for the availability of these external sites or resources and do not endorse or retain responsibility for any content, advertising products, services or other materials on or available from these sites or resources. We give no warranties in respect of such external sites. 

9. Data protection and privacy 

We are committed to protecting your personal data in accordance with applicable data protection laws, including but not limited to the UK General Data Protection Regulations (“UK GDPR”) and the Data Protection Act 2018. Any personal information you provide to us directly and via the Site will be collected, used and stored securely. We take appropriate measures to safeguard your personal data from unauthorised access, disclosure or misuse. By using our Site and the services therein, you agree to our collection and use of your information as outlined in our Privacy Notice. 10. Changes to the terms 

InPost Distribution Limited reserves the right to update or modify the Site and/or the content therein or these Terms at any time. 11. Governing law and jurisdiction 

These terms and your use of this Site are governed by and construed in accordance with the laws of England and Wales notwithstanding any other jurisdiction where you may be based or have accessed or downloaded the Site. Any disputes will be decided only by the Courts of England and Wales, and you irrevocably agree to submit to the exclusive jurisdiction of the courts of England and Wales to resolve any dispute arising out of these Terms. 

12. Miscellaneous 

In the event that any of the Terms are held to be unenforceable or invalid, the remaining Terms shall not be affected. You may not assign or subcontract any of your rights or obligations under the Terms.
